Removing Unnecessary Criminalisation: Reform of Court Election Withdrawal (2026)

This proposal, from the University of Newcastle Legal Centre and led by Ben Nicholson, examined the structural problems created by the lack of a comprehensive statutory mechanism to withdraw a court election after it has been lodged. It argues that the current system disproportionately criminalises individuals for minor regulatory offences, creates avoidable convictions and imposes long term consequences that far exceed the nature and seriousness of the original conduct.
