Description
This course explores the key legal principles that apply to construction law and disputes. It begins with an introduction to the construction industry and the nature of construction law. It moves on to construction contracts and common issues during project delivery (focusing on the critical factors of time, quality and cost). It concludes with an overview of construction claims and disputes, including methods of dispute avoidance and resolution. Students will test their understanding of each of these topics by proposing solutions to problems based on real-world and hypothetical construction projects.

Learning outcomes
On successful completion of the course students will be able to:
1. Evaluate and implement the key principles of construction law
2. Apply the principles of construction law to the selection, preparation, formation and interpretation of contracts
3. Formulate and argue claims and defences in relation to common construction disputes and recommend appropriate methods of dispute resolution and avoidance
4. Identify and apply the legislative and regulatory framework to the delivery of construction projects

Topics will include:
- Introduction to Construction Law
- Construction Contracts
- Time and Programming in construction projects
- Site conditions
- Quality of works and defects
- Price, payment and variations
- Security for performance
- Insurance issues in construction projects
- Construction claims
- Breach and termination of contract
- Dispute avoidance and resolution
- Security of Payment legislation
Each topic will explore one or more critical area of construction law. Key legal principles will be explained along with an overview of significant cases and legislation. The tutorials will focus on problem-based learning as students work through exercises based on real world and hypothetical examples.
