Career Summary

Biography

Mark held the Foundation Chair in Employment Studies at the University of Newcastle from 1997 until early 2021, when he became Emeritus. Before then, he held positions at the Universities of NSW, Wollongong and Sydney.

In February 2019, Mark was awarded the Vic Taylor Distinguished Long-Term Contribution Award by the Association of Industrial Relations Academics of Australia and New Zealand (AIRAANZ). The nomination statement by two very senior colleagues identified three key contributions:

  • “commitment to theoretically-informed and practically useful scholarship and research”;
  • “integration of teaching and research”, notably combined in the vital task of being lead author on a textbook; and
  • “national and international leadership and engagement, from local (Newcastle) to international academic, practitioner and government audiences in Europe, North America and New Zealand”.

Mark's current research interests focus on cooperation at work, especially the role of industrial tribunals in promoting workplace cooperation and performance and the impact of collaborative employment relations on mental health. This was the subject of an ARC Linkage Grant in 2015-2016, which produced his latest book: Mark Bray, Johanna Macneil & Andrew Stewart, Cooperation at Work: How Tribunals Can Help Transform Workplaces (Federation Press, Sydney, 2017). The project has also produced a number of book chapters and articles in high-ranking academic journals, including the British Journal of Industrial Relations.

Mark's other current research interest include the structures and processes of labour regulation, including labour law, collective bargaining and awards. Over his career, he has also researched topics like: industrial relations and human resource management in selected industries (including health, road transport, airlines, electricity generation, aluminium smelting, hospitality); HRM in multinational corporations; national and industry differences in labour regulation; the complexity of labour regulation; and industrial relations public policy.

Mark has taught Australian and comparative industrial relations, human resource management and research methods over many years. Since 2005, he been lead author (with Peter Waring, Rae Cooper and Johanna Macneil) of five editions of Australia's leading university textbook in the field, the most recent being: Employment Relations: Theory and Practice (McGraw-Hill, Sydney, 2018, 4th Edition). Mark has performed in a range of leadership roles at the University of Newcastle, from Head of the Management and Business Schools and Head of the ER & HRM Discipline to various Assistant Deanships.

The sudden and dramatic lockdowns in Australia resulting from the COVID-19 pandemic brought great uncertainty and much change during 2020. This review concentrates on the impacts of these contextual changes on Australian unions and collective bargaining. Union efforts to cooperate with governments in policy-making and with employers at a workplace level were greeted with applause. But other arenas, as the crisis moderated, saw more traditional adversarialism. In particular, the failure of the parties to agree on legislative change meant that the government¿s ¿omnibus¿ bill, presented to parliament in December, would prove controversial and strongly contested in the new year. The structure and process of collective bargaining seemed to change remarkably little in 2020. A closer examination of the practice and outcomes of collective bargaining, however, suggests continued difficult times for workers and unions.

There is a storm brewing over the roles of unions and collective bargaining in Australian employment relations. Unions, frustrated with what they see as practical and legislative restrictions on protection of workers¿ rights, seek to ¿change the rules¿. Employers, on the other hand, have been successful in restricting or rolling back bargaining rights, supported by their associations, the Coalition government and an assertive interpretation of the Fair Work Act. Add to this the impending federal election and the scene is set for a tempest that could bring industrial relations back to the centre of Australian politics in 2019. The review explores the various elements contributing to the coming storm, including trends in union membership, structure and strategy. It also surveys trends in the number and coverage of collective agreements, wage outcomes and industrial disputes. Two idiosyncractically Australian versions of collective agreement making are also discussed: cooperative bargaining facilitated by the Fair Work Commission and non-union collective agreement making.

Purpose: The purpose of this paper is to examine the control mechanisms used by multinational corporations (MNCs) from emerging economies to manage their subsidiaries in developed countries and their implications for human resource management practices. Design/methodology/approach: The paper draws on data collected through in-depth case studies and interviews with senior subsidiary managers of 12 major Indian information technology (IT) MNCs operating in Australia. Findings: Indian IT MNCs rely heavily on the use of people-centric controls exerted through global staffing practices (via the transfer of parent-country nationals), which, in turn, influence their subsidiary¿s discretion over their HR practices. The use of people-centric controls allows Indian IT multinationals to replicate parent-country HRM practices in their Australian subsidiaries in an ethnocentric manner and significantly leverage the people-based competitive advantages from India through short- and long-term expatriate assignments. Research limitations/implications: The study investigates control and HRM practices from a single country and a single industry perspective. It provides an insight into the normative means of control in foreign subsidiaries of MNCs and enhances our understanding by explaining the integrated relationship that control mechanisms (and their people-centric components) have with HRM practices including the global staffing approaches and expatriate management practices of emerging MNCs. Practical implications: Indian MNCs are using their business model to leverage the Australian immigration and skilled visa programme to maintain cost advantages. However, the immigration legislation in developed countries needs to be capable of allowing emerging multinational corporations (EMNCs) to maintain such advantages as developed countries seek to attract foreign direct investment from emerging economies. Originality/value: The results indicate that the control practices of EMNCs are similar to the controls exerted by MNCs from developed countries. They also show that EMNCs do not adopt a portfolio approach to global staffing, and that the people-centric components of their control have a clear impact on their subsidiaries¿ HRM practices.

This paper identifies a model of enterprise bargaining which has recently been advocated by some Australian employer groups. Under this ¿autonomous enterprise'model, ¿genuine¿ enterprise bargaining is supposed to produce comprehensive agreements which set terms and conditions of employment which are company-specific. The experience of enterprise bargaining in the Australian domestic airline industry is then compared with that model. It is found that, contrary to the model, the two major airlines have negotiated enterprise agreements which are remarkably similar, with wage increases and workplace reforms following strong industry-wide trends. The explanation offered for the lack of enterprise autonomy focuses on both institutional factors and structural features of the industry's product. © 1996, University of New South Wales. In recent years award restructuring has emerged as a major public policy instrument for encouraging workplace reform. This article examines the success of this strategy in New South Wales road freight transport at both the industry and workplace levels. While it is found that some significant changes were made to the primary industry- wide award as a result of award restructuring, it is apparent that more rapid and more radical change was prevented by conflict not only between union and employers, but also between different groups of employers. Perhaps more significantly, the impact of these award changes at workplace level is found to be minimal. This failure can be attributed partly to the parties themselves. Employers lacked the unity to achieve a wider agenda at an industry level. Management lacked the will and resources to realize the opportunities for major workplace reform that were presented to them. Union officials, but especially workplace delegates and the rank and file, were reluctant to accept management's agenda for change. However, a more complete explanation for the lack of workplace reform is the inappropriateness of the award restructuring model in an industry where product markets have long been competitive and industrial relations practices relatively flexible. © 1992, Sage Publications. Recent literature on management strategy is drawn upon to analyse managemnt initiatives in New South Wales road transport during the 1960s. In this industry, t strong competition of the time, combined with union action that raised labour cos led to managers both increasing direct control over wage labour within the labo process and switching to indirect control methods through the use of contract labo Three main points emerge from the case-study. The first is the importance of analysi management's choice of industrial relations strategy in the wider context of prodi market and technological contingencies. Second, the growth of contract labour provic a reminder that management does not inevitably respond to competition by assumi greater direct control within the labour process. The study of contract labour and its implications for industrial regulation has been neglected in Australia. As an initial attempt to remedy past neglect, this paper offers an account of contract labour (in the form of self-employed o wner-drivers) and its regulation in one section of the road transport industry, namely, the delivery of ready-mixed concrete in the Sydney metropolitan area. This industry represents an unusual example of contractors becoming strongly unionised and establishing an effective pattern of joint regulation over their rates and conditions. The close relationship between the contractors and the Transport Workers Union has also led to the industry playing an important role in the wider struggle between unions and employers in New South Wales over legislation designed to regulate contract labour. © 1984, Sage Publications.
