This course is Part A of a multi-term sequence. Part B must also be completed to meet the requirements of the sequence.
Builds upon the course Legal Practice 1, focussing on the more advanced aspects of litigation and legal transactions. It gives emphasis to professional responsibility and relevant ethical behaviour. The course is made up of a number of components and modules which cover a variety of areas of legal practice where communication, research, advocacy and legal transaction skill are utilised. Students undertake simulation and drafiting exercises and attend legal office placements in litigation and legal transactions.
| Objectives | The primary objective of this course is to enable students to acquire, by way of experiential learning, some of the knowledge and more advanced skills required of an entry level lawyer. It aims to build upon Legal Practice 1. It aims to enable students to apply earlier learning in both substantive and procedural law in courses such as Torts, Civil Procedure, Family Law, Contract Law, Property Law, Commercial Law and Company Law studied earlier or concurrently in the Law Degree. The course will enable students to further develop and practise the lawyer and other general skills needed in litigation, the settlement of litigious matters and in legal transactions, including effective communication with clients, court room advocacy, advanced drafting, mediation and settlement of non litigious matters. Students will also develop and understand management of legal practices, time management, professional responsibility and professional ethics. Students should have the capacity to utilise and build upon the skills, knowledge and ethics acquired in this course in their professional lives. |

| Content | This course builds upon the course LAWS4054A & LAWS4054B, Legal Practice 1, focussing on more advanced aspects of litigation and legal transactions. It gives emphasis to professional responsibility and relevant ethical behaviour. The course further develops awareness and refines the skills that lawyers need when conducting litigious matters. The course is made up of components and modules which cover a variety of areas where advocacy and legal transaction skills are utilised. These include, Advanced Civil Litigation Practice (Tribunals), Property Law Practice, Wills Practice, Employment and Law Practice. Students undertake simulation exercises and attend legal office placements in litigation and legal transactions. The course examines alternatives to litigation and gives students the opportunity to practice alternate dispute resolution skills. The course also examines, oral and written communication skills, legal letter writing, document drafting, interviewing, research, non-litigious negotiation and settlement skills. |
