LLB courses are only available to students enrolled in Bachelor of Laws (LLB) degree programs.This course is Part A of a multi-term sequence. Part B must also be completed to meet the requirements of the sequence. The separate elements of the sequence must be completed in consecutive terms; i.e. without an intervening term.
Criminal Law & Procedure (Parts A & B) is an introductory course to the Criminal Law. The focus is primarily the criminal laws of New South Wales, although a comparative component is included. The Course will develop your knowledge of the key areas of criminal liability, and aims to develop a critical understanding of the function and application of the criminal law.

This course will introduce students to the principles of criminal responsibility. It will include detailed consideration of a broad range of criminal offences, defences, and the context of the criminal law. The rules of criminal procedure will be examined in some detail.

Objectives Our objective is to promote and develop an appreciation and understanding of the following:

1. the concept of crime and the role of criminal law in society
2. the notion of criminal responsibility
3. the elements of a broad range of criminal offences
4. the elements of the major defences
5. the rules of criminal procedure
6. the principal agencies, procedures and routines involved in the administration of criminal justice, in particular in the policing and prosecution of crime and the sentencing of criminal offenders
7. the principles of sentencing and range of sentencing options
Content This course will introduce students to the principles of criminal responsibility, including detailed consideration of a broad range of criminal offences, such as assault; sexual assault, murder and manslaughter; property offences; drug offences; traffic offences and public order offences. It will examine the major defences and examine in detail the rules of criminal procedure in the criminal justice system, and the major principles of criminal sentencing.
The method of instruction is a combination of critical engagement with primary and secondary sources, and problem-based analysis and application of law.
